It’s too late for the Commons (not the Government in this case) to rely on tha argument. The Tribunal looks at what happened, or was likely to happen, at the imte of the decision to refuse information, not at the circumstances now.

The timing of the recent Conway episode, with the main parties rushing to order disclosure by their MPs, would seem to provide the guvmint with one of its stock refusals to disclose – that it has plans in effect to do so. Is this any concern for your case ?
